Preamble

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationships between Emergency Now, a brand of Barracud'Apps, specialized in the sale of survival and emergency kits, and any natural or legal person wishing to make a purchase on the site www.emergency-now.shop (hereinafter the "Customer").

Any order implies full and unconditional acceptance of these GTC. The Customer acknowledges having read these terms and accepted them before placing an order.

Article 2 - Purpose


These General Terms and Conditions aim to define the rights and obligations of the parties in the context of the online sale of products offered by Emergency Now, including:

- The Ultimate Emergency Now Survival Kit comprising 34 professional tools
- The individual products making up the kit, sold separately if applicable

- Any other product or service offered on the site www.emergency-now.shop



Article 3 - Products and Services


3.1. Product Description
The products are described and presented with the greatest possible accuracy. However, in the event of an error or omission in the description, Emergency Now cannot be held liable.

The photographs of the products are not contractual. Colors may vary slightly depending on screens and computer settings.

3.2. Composition of the Kit
The Ultimate Emergency Now Survival Kit includes 34 items divided into 4 categories:

- Water & Shelter (6 items): 1 thermal survival bag, 1 water filter, 1 collapsible bucket, 1 tactical backpack, 1 poncho, 4 waterproof bags
- Tools & Survival (8 items): 1 4-in-1 sharpener, 4 multifunctional tool cards, 1 folding saw, 1 military shovel, 1 multifunctional knife, 1 tactical whip, 1 multifunctional pliers, 1 compass
- Energy & Communication (6 items): 1 stove, 1 solar and hand-crank radio, 1 solar panel, 1 charging cable kit, 60 fire starter sticks, 2 walkie-talkies
- First Aid & Miscellaneous (14 items): 1 first aid kit (20 rectangular bandages, 20 round bandages, 10 finger bandages, 3.5g of burn gel, 4 iodine swabs, 1 survival whistle, 20 sterile swabs, 10 pins, 1 pair of tweezers, 1 roll of medical tape, 1 eye pad, 1 pair of nitrile gloves, 1 triangular bandage, 3 sterile gauzes, 1 pair of gauze scissors, 1 PBT bandage, 1 TPE tourniquet), 10 iodine tablets, 2 carabiners 25kN, 2 paracords 15m 7 strands, 30 iodine swabs, 50 compressed towels, 6 clip carabiners, 1 tactical belt, 1 set of pots, 1 waterproof deck of cards, 1 sewing kit, 1 fishing line 30m, 1 paracord 30m 10 strands, 1 set of cutlery

⚠️ IMPORTANT: For safety reasons related to air transport and customs regulations, the lighter and matches ARE NOT INCLUDED in the kit. The Customer will need to obtain these items separately.

3.3. Availability
The products are offered for pre-order. Delivery is scheduled from July 2026. The delivery dates mentioned are indicative and may be changed. The Customer will be informed as soon as possible.


Article 4 - Price


4.1. Product Prices
The prices of the products are indicated in euros (EUR), all taxes included (TTC), excluding shipping costs.

The selling price is that in effect at the time of order confirmation by the Customer. Emergency Now reserves the right to change its prices at any time but commits to applying the rates in effect at the time of the order.

4.2. Delivery Fees
Delivery fees are calculated based on the chosen delivery method and the destination address. They are clearly indicated before the final validation of the order.

4.3. Promotions and Discounts
Promotional offers are valid within the limits of available stock and for the indicated duration. Unless otherwise stated, promotions cannot be combined with each other.


Article 5 - Order


5.1. Ordering Process
The Customer selects the products they wish to order and adds them to their cart. They can modify the contents of their cart at any time before validating their order.

The Customer checks the information related to their order (products, quantities, prices, delivery address) and proceeds to payment. The validation of the payment constitutes acceptance of these General Terms and Conditions and the conclusion of the sales contract.

5.2. Order Confirmation
An order confirmation is sent by email to the Customer at the address provided during the order. This confirmation summarizes the details of the order (products, quantities, total price, delivery address).

The Customer is invited to verify the accuracy of this information and to report any errors as soon as possible to the address contact@emergency-now.shop.

5.3. Order Cancellation
The Customer can cancel their order free of charge before the products are shipped. For any cancellation after shipping, the provisions related to the right of withdrawal (Article 8) apply.


Article 6 - Payment


6.1. Payment Methods
Payment is made online by credit card (Visa, Mastercard, American Express) or through the payment methods offered on the site (PayPal, bank transfer, etc.).

Payment is secured by an SSL encryption system. Banking data is not stored by Emergency Now but is directly transmitted to our secure payment provider.

6.2. Full Payment
The total price of the order (products + shipping fees) is due in full at the time of order confirmation, even in the case of delayed delivery.

6.3. Payment Failure
In the event of payment refusal by banking institutions, the order will be automatically canceled. The Customer will be informed by email.


Article 7 - Delivery


7.1. Delivery Area
Products are delivered to the following countries: Belgium, France, Luxembourg, Germany, Netherlands, Spain, Italy, Portugal, and other countries in the European Union.

7.2. Delivery Times
Preordered products will be shipped starting from July 2026. Once the shipment is made, delivery times are estimated as follows: pre-order items will begin shipping in July 2026. Once shipped, estimated delivery times are as follows:
- Belgium: 2 to 3 business days
- France, Luxembourg, Netherlands, Germany: 3 to 5 business days
- Other EU countries: 5 to 10 business days

These times are provided as a guideline and may vary depending on carriers and circumstances (strikes, bad weather, peak activity, etc.).

7.3. Delivery Tracking
A tracking number is provided to the Customer by email as soon as their order is shipped. This number allows for real-time tracking of the package.

7.4. Receipt of Delivery
The Customer is required to check the condition of the package in the presence of the carrier and to make any reservations on the delivery note in case of apparent damage (damaged package, opened, missing products, etc.).

In case of damage, the Customer must:
1. Refuse the package or make precise and detailed reservations on the delivery note
2. Confirm these reservations by registered mail to the carrier within 48 hours
3. Inform Emergency Now at the address contact@emergency-now.shop within 3 business days


Article 8 - Right of Withdrawal


8.1. Withdrawal Period
In accordance with Article L221-18 of the Consumer Code and European Directive 2011/83/EU, the consumer Customer has a period of 14 clear days from the receipt of their order to exercise their right of withdrawal without having to justify reasons or pay penalties.

8.2. Exercising the Right of Withdrawal
To exercise their right of withdrawal, the Customer must notify their decision by means of an unambiguous statement:

8.3. Return of Products
The Customer has 14 days from the notification of their decision to withdraw to return the products. The products must be returned in their original condition, complete (packaging, accessories, instructions, etc.) and in their original packaging.

Return shipping costs are the responsibility of the Customer, unless otherwise agreed by Emergency Now. It is recommended to return the products by registered mail with acknowledgment of receipt.

8.4. Refund
Emergency Now will refund the total amount paid (price of the products + initial shipping costs) within a maximum of 14 days from the receipt of the returned products.

The refund will be made using the same payment method as that used for the order, unless otherwise agreed by the Customer.

8.5. Exceptions
The right of withdrawal cannot be exercised for the products:
- Unsealed after delivery and cannot be returned for reasons of hygiene or health protection
- Damaged or incomplete due to the Customer
- Customized according to the Customer's specifications
- Purchased during a promotional event (pre-order, lottery, contest, etc.)


Article 9 - Warranties


9.1. Legal Compliance Warranty
In accordance with articles L217-4 and following of the Consumer Code, all products benefit from the legal compliance warranty of 2 years from the date of delivery.

The Customer may request:
- The repair or replacement of the defective product (at the Customer's choice)
- Otherwise, a price reduction or contract termination (return of the product for a refund)

9.2. Warranty for Hidden Defects
In accordance with articles 1641 and following of the Civil Code, the Customer may also invoke the warranty for hidden defects for defects not apparent at the time of delivery.

9.3. Commercial Warranty
Emergency Now offers a 30-day satisfaction or money-back guarantee on the Ultimate Survival Kit (excluding unsealed or used products and excluding promotional actions).

9.4. Implementation of Warranties
To assert their rights under the warranties, the Customer must contact Customer Service at the address contact@emergency-now.shop providing:
- The order number
- A detailed description of the observed defect
- Photographs if possible
- A copy of the invoice


Article 10 - Gold Raffle


10.1. Presentation
Emergency Now is organizing an exceptional raffle: 3 kits contain real gold hidden inside, for a total value of €1170.

- 1st prize: Napoleon Gold (value: €750)
- 2nd prize: 2g Gold Bar (value: €280)
- 3rd prize: 1g Gold Bar (value: €140)

10.3. No Purchase Necessary
The drawing is conducted randomly and fairly. The gold is hidden in the kits before shipping. No exchange or refund of the gold is possible.


Article 11 - Liability


Emergency Now is committed to making its best efforts to ensure the quality and safety of the products offered. However, its liability cannot be engaged in the following cases:
- Non-compliant or inappropriate use of the products
- Failure to comply with the usage and safety instructions
- Modification or alteration of the products by the Customer
- Force majeure (natural disasters, strikes, wars, etc.)
- Acts of a third party or the Customer

The products offered are survival and emergency equipment. Emergency Now cannot be held responsible for damages resulting from improper use or in situations for which the products are not designed.


Article 12 - Intellectual Property


All elements of the site www.emergency-now.shop (texts, images, logos, videos, etc.) are protected by copyright, trademark law, and/or database rights.

Any reproduction, representation, modification, publication, or adaptation, in whole or in part, of the elements of the site, by any means or process, is prohibited without the prior written permission of Emergency Now.


Article 13 - Personal Data Protection (GDPR)


13.1. Data Collection
In accordance with the General Data Protection Regulation (GDPR - EU 2016/679), Emergency Now is committed to protecting the personal data of Customers.

The data collected is necessary for processing the order and managing the customer relationship:
- First name, last name
- Email address
- Shipping and billing address
- Phone number
- Payment information (processed by our secure provider)

13.2. Use of Data
The data is used exclusively for:
- Processing and tracking orders
- Managing Customer Service
- Sending information related to products and services (with consent)
- Preventing fraud
- Improving our services

13.3. Customer Rights
In accordance with the GDPR, the Customer has the following rights:
- Right of access: to obtain a copy of the personal data held
- Right to rectification: to correct inaccurate or incomplete data
- Right to erasure: to request the deletion of data ("right to be forgotten")
- Right to restriction: to limit the processing of data in certain cases
- Right to data portability: to receive data in a structured format

13.4. Security and Retention
Emergency Now implements all appropriate technical and organizational measures to protect data against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Data is retained for the duration necessary for the purposes for which it is processed, in accordance with legal and regulatory obligations.

Article 14 - Mediation and Dispute Resolution


14.1. Customer Service
In case of a complaint, the Customer is invited to contact Emergency Now's Customer Service as a priority:

14.2. Consumer Mediation
In accordance with Article L612-1 of the Consumer Code, the Customer has the right to use a consumer mediator free of charge for the amicable resolution of the dispute.

Article 15 - Applicable Law and Competent Jurisdiction


These General Terms and Conditions are governed by Belgian law and European law applicable to distance selling.

In the event of a dispute and failing an amicable resolution, the courts of Brussels (Belgium) will have exclusive jurisdiction, unless contrary public policy provisions apply.


Article 16 - Modification of the General Terms and Conditions


Emergency Now reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in effect on the date of the order.

In the event of a substantial modification, Customers will be informed by email or via a notice on the website.


Article 17 - Miscellaneous Provisions


17.1. Partial Invalidity
If one or more provisions of these General Terms and Conditions are held to be invalid or declared as such under a law, regulation, or as a result of a final decision by a competent court, the other provisions will retain their full force and scope.

17.2. Non-Waiver
The fact that Emergency Now does not temporarily or permanently invoke one or more provisions of these General Terms and Conditions cannot be interpreted as a waiver of the right to invoke them later.

17.3. Language
These General Terms and Conditions are written in French. In the event of a translation into another language, only the French version will be authoritative in case of dispute.
